What is the 80/20 labor rule?
- Introduced in December 2021, this rule applies if you take the tip credit.
- If tipped workers are paid the tipped wage during their shift, any supportive work cannot exceed 20% of their workweek OR 30 continuous minutes.
- If tipped workers engage in unrelated activities, they must be paid full minimum wage for that time.
- If a tipped employee performs directly supporting work for over 30 continuous minutes, the employer cannot take a tip credit for any time exceeding 30 minutes.
- Time exceeding 30 minutes, for which the tip credit cannot be taken, is excluded from calculating the 20% level.
