What is the 80/20 labor rule?
Introduced in December 2021, this rule applies if you take the tip credit.
If tipped workers are paid the tipped wage during their shift, any supportive work cannot exceed 20% of their workweek OR 30 continuous minutes.
If tipped workers engage in unrelated activities, they must be paid full minimum wage for that time.
If a tipped employee performs directly supporting work for over 30 continuous minutes, the employer cannot take a tip credit for any time exceeding 30 minutes.
Time exceeding 30 minutes, for which the tip credit cannot be taken, is excluded from calculating the 20% level.

Carmen Rodriguez is a graduate of The University of the Sacred Heart in Santurce, Puerto Rico, where she earned her Bachelor’s Degree in Communications. She began her Wage and Hour journey in 1997 as an Investigator in the Tampa District Office. She transferred to the Orlando District Office in 2022. As a Senior Investigator, she’s completed investigations in all the laws enforced by Wage and Hour. She is currently on detail as the Community Outreach and Resource Planning Specialist. She travels through Central and North Florida educating the community in the laws enforced by the Wage and Hour Division of the U.S. Department of Labor.
